General terms and conditions

1. General

1.1. These general terms and conditions apply to all agreements between Sisu Repair and its clients.

1.2. Sisu Repair reserves the right to amend these general terms and conditions. Amendments will be published on the website and, where relevant, communicated via email to clients with ongoing agreements. For new agreements, the changes take immediate effect. Ongoing agreements remain governed by the old terms unless the client explicitly agrees to the amended terms. If the changes significantly affect the client’s rights or obligations, the client has the right to terminate the agreement free of charge within 30 days of notification.

1.3. Sisu Repair will endeavor to keep the client informed about the status of the assignment via email, phone, or WhatsApp, provided contact details are available.

1.4. Sisu Repair reserves the right to refuse assignments without providing reasons.

1.5. The client must only submit the items to be repaired. Accessories or other items not required for the repair will not be accepted.

2. Quotations

2.1. Quotations are non-binding and valid for 30 days unless otherwise stated.

2.2. Quotations are provided in writing. Verbal price agreements are confirmed in writing, with the written amount prevailing.

2.3. The prices stated in the quotation are binding and may differ from the rates listed on the website.

2.4. Stated repair times are indicative and non-binding. Exceeding the delivery period does not entitle the client to compensation.

3. Prices and Payments

3.1. All prices include VAT and are expressed in euros.

3.2. Sisu Repair may require a deposit before ordering parts. Repairs will only commence upon receipt of the deposit.

3.3. Payments must be made via bank transfer, payment request, or in cash.

3.4. Full payment must be made before the repaired items are handed over.

3.5. If payment is not made, Sisu Repair reserves the right to exercise the right of retention and/or charge storage fees of €10 per week.

3.6. Items must be collected within 14 days of notification of readiness. Failure to do so may result in storage fees of €10 per week. Additionally, the client assumes the risk for damage, loss, or theft of the items after this period, as they will no longer be insured under Sisu Repair’s contents insurance.

3.7. If items are submitted wet and/or dirty, Sisu Repair reserves the right to charge additional cleaning costs as listed on the website. These costs will be discussed with the client beforehand. If the client does not agree, they may cancel the agreement.

3.8. All judicial and extrajudicial costs reasonably incurred by Sisu Repair as a result of the client’s non-compliance with payment obligations will be fully borne by the client.

4. Liability

4.1. Sisu Repair is only liable for direct damage resulting from an attributable failure in the execution of the agreement.

4.2. Liability is limited to the invoice amount of the specific assignment.

4.3. Sisu Repair is not liable for indirect damage, such as loss of profit or consequential damages.

4.4. Sisu Repair is not liable for design flaws by the original manufacturer or repairs performed by third parties.

4.5. If Sisu Repair arranges transport, it is liable for damage during transport unless the damage is beyond its control. However, Sisu Repair’s liability is limited. See section 6.4 for further details.

5. Complaints and Warranty

5.1. Complaints must preferably be reported in writing within 14 days of delivery. If a complaint is reported later, the client retains their statutory rights provided the report is made within a reasonable period after discovering the defect.

5.2. Sisu Repair offers a 3-month warranty on completed repairs, exclusively for complaints demonstrably related to a shortcoming in the repair. Exceptions to this warranty apply to leaks and wetsuit repairs, which have limited warranty coverage.

5.3. If a complaint is deemed valid, Sisu Repair will provide a repair free of charge.

5.4. If Sisu Repair has made an error, it will have the opportunity to rectify the mistake within a reasonable period.

5.5. Color differences and minor deviations resulting from repairs by Sisu Repair are considered insignificant and do not constitute grounds for terminating the agreement or claiming damages.

6. Shipping and Visits

6.1. The collection and delivery of items to Sisu Repair are by appointment only.

6.2. Collecting items from Sisu Repair by someone other than the client is only possible after consultation between the client and Sisu Repair.

6.3. Shipping items is at the client’s risk. It is recommended to take out transport insurance.

6.4. If Sisu Repair arranges transport, it is responsible for damage or loss during transport unless the damage is beyond its control. Sisu Repair’s liability in such cases is limited to the invoice amount of the assignment. If the client does not agree to this limitation, they must arrange their own transport and, if desired, transport insurance. By agreeing to transport arranged by Sisu Repair, the client accepts this limitation of liability.

7. Force Majeure

7.1. In the event of force majeure, Sisu Repair is not obliged to fulfill its obligations. The obligations are suspended for the duration of the force majeure.

7.2. Force majeure includes any circumstance beyond Sisu Repair’s control that prevents fulfillment of the agreement, including but not limited to: telecommunications disruptions, strikes, natural disasters, illness, fire, or government measures.

8. Applicable Law

8.1. All agreements between Sisu Repair and the client are governed exclusively by Dutch law.

8.2. Any disputes will be submitted to the competent court in the district where Sisu Repair is established.

8.3. The Dutch version of these general terms and conditions prevails over any translations.
